By accessing or using mysmartfunding.com (the "Site") or submitting an application through it, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.
My Smart Funding is a lead-generation service that connects consumers with a network of independent, third-party lenders and lending partners ("Lending Partners"). My Smart Funding is not a lender, does not make credit or lending decisions, and does not guarantee that you will receive an offer, a specific loan amount, or specific terms. Any funding offer you receive comes from a Lending Partner, not from My Smart Funding, and is subject to that Lending Partner's own approval criteria, terms, and disclosures.
You must be at least 18 years old and a legal resident of the United States to use the Site. By submitting an application, you represent that the information you provide is accurate and that you are submitting it for your own use.
When you complete the application, you authorize My Smart Funding to share the information you submit — including identity, financial, employment, and banking information — with our network of Lending Partners for the purpose of evaluating you for a funding offer. Our collection and use of your information is also described in our Privacy Policy.
By submitting the application and checking the applicable consent boxes, you agree that My Smart Funding and/or its Lending Partners may contact you by email, phone call, and SMS/text message — including by autodialed, automated, or prerecorded means — at the email address and phone numbers you provide, even if those numbers are listed on a state or federal Do Not Call registry. Consent to be contacted is not a condition of obtaining funding. Message and data rates may apply, and you may opt out of marketing messages at any time as described in our Privacy Policy.
Submitting an application does not guarantee approval, a specific loan amount, or specific rates or terms. All lending decisions are made solely by the Lending Partner you are matched with, based on their own underwriting criteria.
You agree not to: submit false or fraudulent information; use the Site to submit an application on behalf of someone else without authorization; attempt to interfere with or disrupt the Site's operation; or use the Site for any unlawful purpose.
The Site, including its design, text, graphics, and logos, is owned by or licensed to My Smart Funding and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written consent.
The Site and its content are provided "as is" without warranties of any kind, express or implied. My Smart Funding does not warrant that the Site will be uninterrupted, error-free, or that any application will result in a funding offer.
To the fullest extent permitted by law, My Smart Funding will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any transaction with a Lending Partner, including damages arising from a Lending Partner's decision, terms, or conduct.
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of [State], without regard to conflict-of-law principles, unless otherwise required by applicable law.
